Important Safety Information for Your Wingman Harness

The Wingman Harness is a harness designed to assist a user during physical or occupational therapy and encourage them to participate more fully, engage the core and strengthen muscles needed for daily activities.

WHEN USED AS INTENDED THIS PRODUCT CAN IMPROVE PATIENT SAFETY.  DO NOT USE OTHER THAN INTENDED. 

Anything with straps has a risk of strangulation.  Always monitor the use of items with straps to minimize this risk, especially in smaller children. Ensure proper fit as provided in adjusting instructions. Prior to use always inspect the unit for any signs of wear or damage and do not use if damage is noted.
 
Caution: You should also be healthy enough and physically capable enough to use this device. If you are not sure if you are healthy enough to use this device always consult a doctor. Make sure the harness is adjusted properly and a comfortable fit is obtained prior to using the device. The harness is made with high quality materials and stitched by people who know what they are doing with high quality stitching to reinforce its strength; however, random failures are always possible in any device. Always be ready if a failure should occur. Also a precaution while using the Wingman Harness in snow, you should never use this device near cliffs or high drop offs where a fall could injure either the user or the assisting party. By using this device you agree that we are not responsible for any physical or mental injury to the adult or child that may occur while receiving physical, occupational or other therapy, or any other activity with this device. We are not responsible for any therapy or other equipment damage incurred while using this device.

WARNING

Physical activity and even therapy can sometimes be dangerous and injury can occur. It is the sole responsibility of the purchaser or user of any Wingman Harness equipment to get proper instruction and to act safely and in accordance with the uses and specifications outlined in the product literature. It is your responsibility to learn how to use the product safely. INSPECTION

Inspect your unit before each use. If you notice anything that might be a problem, seek a professional opinion before continuing use of the product. Check sewn goods for excessive abrasion, frayed or cut stitching and overall integrity. Check hardware for cracks, fissures, dents, loose parts and general smooth operation. Check handles and buckles for excessive wear and tear. If the individual needs a helmet, then always wear a helmet and check those helmets for any depressions and check the integrity of the foam for any compression (compressed areas will no longer absorb the energy of an impact) or cracks. DISCLAIMER OF LIABILITY

The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness,  and its parent company Genius Happens LLC, and specifically this Wingman Harness, equipment must be used in accordance with the manufacturer's instructions and only for the specified purpose for which it was designed.  The Uninsured Wingman Harness Company LLC  and/or its parent company Genius Happens LLC shall not be liable for any consequential damages, injury, paralysis or death arising from any use or misuse of its products, to include this Wingman Harness. In using The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness, equipment, and this or any Wingman Harness, you (the customer) assume the responsibilities of ownership and operation, and you agree to hold harmless The Uninsured Wingman Harness Company LLC,  and its parent company Genius Happens LLC, owners, partners and employees for any incident or action involving the use The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness,  and its parent company Genius Happens LLC products and/or the Wingman Harness, equipment.

WARRANTY

The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness,  and its parent company Genius Happens LLC warrants that its product will meet the specifications stated in the instructions and The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness agrees to replace the product free of charge if the product does not conform to the specifications. Notice for replacement must be given within 30 days of the discovery of the defect.
 
In consideration of the above warranties by The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness, and its parent company Genius Happens LLC, the customer agrees to and accepts the following conditions:

  • That this warranty is in lieu of all other warranties, expressed or implied;
  • That ALL WARRANTIES OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY EXCLUDED AND/OR WAIVED;
  • That the buyer's sole remedy shall be to obtain replacement of the product free of charge from The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness

 
That this remedy is in lieu of all other remedies or claims for damages, consequential or otherwise, which the buyer may have against The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness, and its parent company Genius Happens LLC shall have no liability for:

  • Any loss or injury caused, in whole or in part, by its actions, omissions, or negligence, or for contingencies beyond its control, in procuring, compiling, or delivering the Information;
  • Any errors, omissions, or inaccuracies in the Information regardless of how caused, or delays or interruptions in delivery of the Information; or
  • Any decision made or action taken or not taken in reliance upon the Information furnished hereunder.

The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness equipment is warranted to be free of defects in materials and workmanship for a period of one (1) year from the date of shipping. During the warranty period the unit will be repaired or replaced by The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness  at no charge as long as the unit has not suffered accidental damage, abuse, abnormal wear and tear, or misapplication. Such damage will be repaired at the purchaser's expense. Opening or altering the Product in any away voids this warranty. The warranty extends only to you, the original purchaser. It is not transferable to anyone who subsequently purchases or uses, to include renting, the The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness equipment, and specifically to include the Wingman Harness, from you.  As a business you, by renting or supplying the equipment to additional third parties, agree that you are responsible for any remedies or claims for damages, consequential or otherwise, which the actual user may have against The Uninsured Wingman Harness Company LLC d.b.a Wingman Harness,  and its parent company Genius Happens LLC.
